1. 1. General provisions

This policy for processing personal data is part of the legal warning on the website www.silex-partners.com (hereinafter the ‘Site’) applies to any user of the Site and describes the processing of any personal data collected by SILEX when accessing the Site by the user as well as during its use.

2. 2. Personal Data Collection

By using the Site and providing personal information, you accept the collection and use of data in accordance with this Personal Data Processing Policy. Navigation on the Site is possible without providing Personal Data concerning you. However, for access to certain parts of the Site, for example for the downloading of certain documents, or as part of another specific use, SILEX may be required to ask you for Personal Data. Communication of Personal Data in this context is voluntary. If you do not provide this Personal Data, you will not be able to benefit from the corresponding services offered by the Site, such as newsletters and downloading of documents. The reasons why your Personal Data is collected are set out below, accompanied by a brief description of how this data can be processed in each case.

2.1. Communicate with SILEX

We will follow up on your comments, as well as other requests that you may submit to us through the Site, such as your online questions, business applications or registration of your participation in an event. For this purpose, it may be necessary for us to contact you by telephone or for us to communicate with you by email.

2.2. Direct marketing and promotion

Direct marketing and/or promotional operations carried out by SILEX may imply that we provide you with specific information that you have requested online or more general information on SILEX offers. Where we gather Personal Data for marketing or promotional purposes, we offer you appropriate choices as to their use.

2.3. Maintenance of the Site and conduct of client research

SILEX will use your Personal Data to keep up to date and improve the Site. SILEX will also use your Personal Data to conduct client satisfaction studies.

2.4. Compilation of comprehensive statistics on the use of the site

3.1.4. Targeting cookies

Targeting cookies are used to measure the effectiveness of an advertising campaign by allowing targeted advertisements to be distributed to users and whose recurrence is limited. These cookies record a user's visit to a site.

3.1.5. Use of cookies

SILEX may use Personal Data collected by our cookies to analyse the behaviour of site users and thus provide more personal content and offerings. The performance cookies used on the Site do not collect Personal Data. Cookie information placed by our advertising links on third party sites may collect Personal Data. SILEX is making its best effort to comply with the RGPD regulation.

SILEX also uses technologies that are substantially similar to cookies such as Internet beacons or any other technology that may appear in advertising e mails or newsletters to determine whether these messages have been consulted or whether you have clicked on the links they contain. Internet beacons do not file any data on your computer, but may be used in parallel cookies to analyse the site's navigation activity.

SILEX may use external vendors to collect, use and process Personal Data in any way on our behalf. It is our rule to require these external suppliers to process Personal Data in accordance with SILEX's confidentiality and security commitments.

SILEX may communicate your Personal Data to enforce the Terms of Use of the Site or in the event of emergencies to ensure the safety of persons, or to protect the public or the Site. SILEX could also communicate your data under the law, on a court decision, mandate, order or other regulation in any country where SILEX is located.

In any event, you have a right of access to your Personal Data. You may also request that your personal data be rectified or deleted. You also have the right to oppose the processing of your personal data or to request the restriction of your processing. To exercise your rights with respect to your Personal Data, you must insert a copy of a valid identification document (identity card or passport) in the following format: GIF, JPG, PNG, PDF, maximum 2 MB. In all cases, you also have the right to file a complaint with the data protection authority.

7. Duration of your Personal Data kept

SILEX retains your Data only in accordance with the purposes of its treatment, and in compliance with its legal and regulatory obligations. The length of time you keep your Data is variable and depends on the purposes pursued by our treatments:

SILEX uses various technical security measures or establishes adequate Charts to protect personal data collected, used or transferred from losses, misuse, falsification or destruction. However, since the Internet network is open to all and not secure, SILEX cannot be held responsible for the security of the communication of Personal Data via the Internet.

9. External websites

The Site may provide links to external websites. SILEX does not provide any guarantee or make any representations with respect to these external websites. Owners and operators of these external websites may collect, use or transfer Personal Data under terms and conditions different from those of SILEX. By connecting you to an external website, you must inform you about the confidentiality and security measures of these external websites.

CANDIDATES'S DATA

What purpose do we use your personal data?

The SILEX Group, hereinafter ‘SILEX, us,’ as the person responsible for processing, collecting and processing your personal data solely for the conduct of its recruitment operations, i.e. to assess whether your profile corresponds to the post you have applied for within SILEX.

It is necessary that you provide us with this personal data so that we can review your application and ability to take up a job within SILEX. If you do not provide us with this information or if you choose to withdraw your contact details from our database, we will no longer be able to carry out this examination of your application, or possibly propose to you the conclusion of an employment contract.

What is the legal basis for this treatment?

We use your personal data for recruitment purposes (i) as part of the execution of pre contractual measures made at your request and/or (ii) because of our legitimate interest in making the best hiring decision for SILEX.

With whom does SILEX share your data ?

SILEX has a candidate database which the General Departments of SILEX entities can access in order to be able to contact you for any potential opportunities within our Group. The list of such entities, including their current location, is available here.

Some SILEX entities may be located outside the EU/EEA in countries that do not provide the same level of personal data protection. Internal transfers within SILEX, from European SILEX entities to SILEX entities outside the EU/EEA, will be carried out in accordance with contracts incorporating the European Commission's Model Contractual Clauses.

If applicable, you are entitled, by written request addressed to dpo@silex-partners.com, to obtain a copy of the relevant provisions of these contracts including appropriate guarantees implemented in order to protect your personal data.

How long does SILEX keep your personal data?

If you do not follow up after you have been contacted for an opportunity or if we do not currently have an opportunity corresponding to your profile, we will keep your documents (including your personal data) in your file for future job opportunities within SILEX, for a maximum period of two years from our last contact with you (reconductable period once, only where a specific job to be filled requires).

Conversely, if you are retained for a position within SILEX, we will keep the documents (including your personal data), transmitted through your care, for the duration of our working relationship and the applicable statutory prescription period."

What are your rights with regard to your personal data?

  • The right to request access to your personal data kept by SILEX, as well as the right to request the correction of any personal data that may be inaccurate, incorrect or incomplete
  • The right to receive the personal data you have provided to SILEX, in a structured, commonly used and readable format by machine, as well as the right to ask us to transmit this data to a third party where technically possible and in specific circumstances
  • The right to cancel your personal data under specific circumstances
  • The right to limit the processing of your personal data, in specific circumstances; where your personal data is subject to such a limitation, we will only deal with them (with the exception of its retention) with your consent or for the recognition, exercise or defence of rights in court
  • The right of opposition to treatment: Where the treatment is based on legitimate interests, you have the right to oppose it at any time. If you oppose it, we must put an end to the treatment unless we are able to demonstrate that there are legitimate and compelling grounds for the treatment that prevails over your interests, rights and freedoms, or that we have to treat these personal data for the recognition, exercise or defence of rights in court.

You also have the right to lodge a complaint with the supervisory authority of your usual residence, place of work or place where the breach would have occurred, if you consider that the processing of your personal data constitutes a breach of applicable law.
